Terms and Conditions

Agreement

Council has established and maintains a system/database (‘the system’) for the lodgement of online applications.

The applicant wishes to obtain a non-exclusive, non-transferable right from council to lodge applications online using the system.

Council is prepared to grant this right subject to these Terms of Use and the terms and conditions set out below.

 

Indemnity

The applicant agrees to indemnify council in respect of all claims for loss, damage or injury which may be suffered by any person arising directly or indirectly from the fraudulent, malicious or negligent activity in the applicant’s use of the system.

The applicant agrees to indemnify council and not raise any claim against council in respect of any loss, damage or injury which may be suffered by council, the applicant or any third party as a result of the applicant granting higher level access to any of its employees, servants, contractors or consultants which may result in the deletion or amendment of any of the applicant’s or council’s details, files, information and material.

Both parties shall indemnify the other against any loss or damage that may be sustained or incurred as a result of the failure by a party to perform its obligations under this agreement.

 

Obligations of applicant

The applicant will notify council as soon as practicable if the applicant becomes aware of any unauthorised use of the whole or any part of the system.

The applicant will use its best endeavours to promptly bring to the attention of council the unethical or dishonest activity in relation to the use of the system that the applicant may discover.

The applicant will give council such assistance and cooperation as it reasonably requires in connection with the operation of this agreement.

The applicant will use its best efforts to ensure that any lodgement performed by any of its employees, servants, contractors or consultants does not involve or cause any corruption of, introduce any errors into or make any amendments or changes to the documents lodged.

The applicant will ensure that any form comprising part of the document lodged under this agreement is the original form completed and signed (where applicable) and not a copy of the original form.

The applicant will ensure that any images of documents transmitted under the system are of a standard and in a format approved by council.  Prior to lodging, the applicant will use its best efforts to ensure all form types and fees entered during the process of any lodgement are correct.

The applicant will notify council of any change in business name, contact details or cessation of its business within seven days of the occurrence of the change.

 

Security

The applicant will apply to council for the ability to lodge documents on the system and nominate the employees that will have access to the system.

The applicant will be solely responsible for the conduct of its employees, servants, contractors and consultants in their use of the aystem.

Where a security violation is detected by council, the applicant will be deemed to have breached this agreement and council may take whatever action is necessary in respect of any such breach.

The applicant acknowledges that: this is a service for the applicant, its employees, servants, contractors and consultants who need such access for the purpose of the applicant exercising its rights under this agreement unauthorised or attempted unauthorised use of the system is prohibited and may constitute an offence under federal, state and local laws access privileges to the system may be revoked at any time without notice if there is a breach of the provisions of this agreement, in particular if there is a security violation and
access will be logged and may be monitored at any time.

In addition:

The applicant will ensure that the password is changed whenever requested to do so by council.
Failed login attempts may be monitored to determine if security is being compromised.
The applicant shall take all reasonable steps to maintain and safeguard the security of access to the system and take all reasonable steps to ensure that its employees, servants, contractors and consultants maintain the security of the system .

 

Applicant’s acknowledgements

The applicant acknowledges and agrees that: council has no control over the speed of transmission of the data when using the internet to access the system. council will use its best efforts to provide access to the system but does not warrant that access to the system will be uninterrupted. 

For example, access may be interrupted to facilitate urgent maintenance.  Council will not be liable to the applicant or to third parties for any interruptions to the system beyond its control including but not limited to problems with the applicant’s:
Telecommunications services
Internet service provider
or
hardware or software.

The applicant acknowledges that this agreement does not otherwise override or amend any obligation, time period or requirements otherwise set down by law, regulation or contained in any council application forms.

 

Social Media Policy and Guidelines

 Use of the Facebook page "Sunshine Coast Stadium"

Sunshine Coast Stadium is a Sunshine Coast Council venue.

Through Facebook, Sunshine Coast Stadium aims to keep you up to date on all the latest news and events happening at the precinct. Posts will include:
• upcoming events and activities happening at Sunshine Coast Stadium
• important news updates
• links to interesting and useful information about the Sunshine Coast and whats happening in the region
• replies and direct messages.
 
Post and replies
Sunshine Coast Stadium will reply to you as quickly as possible, however staff are available during business hours only – 8.30am to 4.30pm Monday to Friday.
Please note that Sunshine Coast Stadium's Facebook page is moderated and any vexatious, defamatory or malicious comments will be removed.

Do not:
 • Post anything that could be considered prejudicial, racist, off-topic, inflammatory, repetitive, vexatious, offensive or otherwise inappropriate.
 • Swear. We want everyone to be comfortable visiting here to get the information we try to provide.
 • Harass or make personal attacks against other users. Please be respectful of others and their opinions.
 • Repost other people's appeals, requests or offers, or anything else that could be considered spam.

TERMS AND CONDITIONS FOR GENERAL SUNSHINE COAST STADIUM COMPETITIONS

Sunshine Coast Stadium competitions include, but are not limited to, ballot entries on event days, 50/50 draws, prizes from survey entries, entries retrieved via Seat Advisor and entries based on certain ticket purchases.

The competition will commence on the date advertised online, through social media, radio, television, print media, etc.

Age of allowed entrants is subject to change depending on the nature of the competition. If any age restrictions, it will be properly advertised.

Only one entry per person unless otherwise stated. This competition is open to Australian residents only. Employees of Sunshine Coast Council including Sunshine Coast Stadium, Corporate Sponsors or patrons with Complimentary tickets are not permitted to enter into any competitions that are presented by Sunshine Coast Council establishments.

It is a condition of accepting the prize that the winner may be requested to sign a legal release form determined by the Promoter in its absolute discretion.

Use of personal information is for competition use only should the entrant win and need to be contacted. Mobile numbers and e-mail addresses will also be used for marketing purposes if the entrant gives necessary permissions to use their information for this purpose. 

Any entrant that wins on the day of an event must be present and come forward to collect the prize on the event day unless otherwise informed. If they are not present a new winner may be declared. Once a winner is drawn and they collect their prize there will be no further action or discussions regarding the competition. 


TERMS AND CONDITIONS FOR SUNSHINE COAST STADIUM FACEBOOK COMPETITIONS

The competition will commence on the date of the post to the specified time selected by the promoter. The winning entries will be selected by the promoter and announced via the Sunshine Coast Stadium Facebook page.

All entrants must be over the age of 15 years to enter. Only one entry per person, per day is permitted. This competition is open to Australian residents only. Employees of Sunshine Coast Council including Sunshine Coast Stadium are not permitted to enter into any competitions that are presented by Sunshine Coast Council establishments. The competitions will be judged on the creative answer to the competition question. The winning entries will be deemed the winners and no further discussions will be entered into.

Entry is via the Sunshine Coast Stadium Facebook page. The name of the winners will be published on the Sunshine Coast Stadium Facebook page. The winner must message their contact details to Sunshine Coast Stadium Facebook by 12:00pm the following day to facilitate delivery of the prize. Winners will have to sign a terms and conditions form to prove they have received their prize.

It is a condition of accepting the prize that the winner may be requested to sign a legal release in a form determined by the Promoter in its absolute discretion.

These promotions is in no way sponsored, endorsed or administered by, or associated with, Facebook and all entrants in the promotion release Facebook of any responsibility in relation to this promotion.

Personal information supplied in entering this competition is provided to the promoter and not to Facebook. Use of personal information will be in accordance with the Data Use Policy as displayed http://www.facebook.com/about/privacy/


GUESS THE SCORE - TERMS AND CONDITIONS

1. To enter competition a score prediction must be posted on the competition Facebook post. To win the prize the score must be exactly correct as per the end result of the stated match.

2. No “edited” posts will be valid.

3. Strictly only one entry per person.

4. Information on how to enter and prizes form part of these Terms and Conditions. Submission of an entry into this promotion is deemed acceptance of these Terms and Conditions.

5. Entry is open to Australian permanent residents aged 18 years and over. Employees, Directors and their immediate families of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.

6. Competition closes at the start of the selected game.

7. Personal information disclosed is provided to Sunshine Coast Stadium only.

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. Incomplete, indecipherable, or illegible entries will be deemed invalid.

10. The Promoter's decision is final and no correspondence will be entered into.

11. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

12. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) the acceptance or use of a prize; (g) any act or omission of the Promoter or its associated agencies.

15. As a condition of accepting the prize, the winner (and any companion/s) may be asked to sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.

16. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the promotion. Entry is conditional on providing this information. If entrants indicate their consent on the entry form, each entrant agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

TYPHOON 50 SCOOTER COMPETITION - TERMS AND CONDITIONS

1. To enter competition you must be given a competition ballot upon arriving at Sunshine Coast Stadium. Entry tickets and Complimentary tickets are invalid as an entry into the competition.

2. To be a valid entry the consumer must put a valid phone number and email on the entry form or submit these details when purchasing their ticket online.

3. Strictly only one entry per ticket holder per game day.

4. Information on how to enter form part of these Terms and Conditions. Submission of an entry into this promotion is deemed acceptance of these Terms and Conditions.

5. Entry is open to Australian permanent residents aged 17 years and over that hold a valid driver's license. Employees, Directors and their immediate families of the Promoter and printers, suppliers, providers, sponsors and agencies associated with this promotion are ineligible to enter.
